MINUTES: APRIL 27, 2004 AT 9:30 AM

 

COMMITTEE ON PUBLIC WORKS MEMBERS PRESENT: Legislators Pinto (Acting Chair of Committee), Oros, Rogowsky, Chairman of the Board Ryan; STAFF PRESENT: Neglia, Perez-Sotillo

IN ATTENDANCE: Comm. Butler (DPW); B. Rehm (Public Safety); J. Phelan (DEF); Legislator LaMotte (BOL); Bruce Bellom (Public Safety, Traffic Division); A. Neuman & B. Randolph (C.E.’s Office)

ON THE MOTION OF LEGISLATOR PINTO, SECONDED BY LEGISLATOR OROS, THE MINUTES WERE APPROVED ON JUNE 15, 2004. ALL IN FAVOR – AYE – 3-0.

MINUTES:

Meeting called to order by Legislator Pinto (Acting Chairman) at 9:45 AM.

Legislator Pinto stated that Chairman Young could not be available for the meeting today, and he asked Legislator Pinto to Chair the meeting.

There is a quorum of three (3) present at the meeting.

Referrals Discussed Today:

12. HON. VITO PINTO: Woodlands Viaduct Bridge: Memorandum from Legislator Pinto regarding safety at the Woodlands Viaduct Bridge on the Bronx River Parkway. (03/08/04)

Legislator Pinto stated that he submitted a letter based on some Town of Eastchester concerns that were raised to him at town board meeting regarding the ‘Woodlands Avenue Viaduct’ safety and also the new traffic light installed for the southbound traffic at exit 9 (Leewood Tunnel) on the Bronx River Parkway.

Commissioner Butler (DPW) stated that the design of the ‘Bridge’ was approved by both federal and state regulations as well as the signage approved by the New York State Manual of Traffic Control Devices. Four ‘speed signs’ are going to be installed within the next few weeks to curb excessive speeding.

Leg. Pinto suggested a press release be put out to alert the public of the new signage put up.

Leg. Pinto stated that the new traffic light at exit 9 has problems with the ‘turn signal,’ and that it is very confusing. He suggested that DPW report on this situation to the town of Eastchester and perhaps the city of Yonkers.

Motion by Leg. Pinto to ‘Receive and File’. Second by Leg. Rogowsky. All those in favor - Aye - Carried 2-0.

1. COUNTY EXECUTIVE: Sewer District Modification: Act modifying the Peekskill Sanitary Sewer District by the addition of 1 parcel located at the site of the Baldwin Place Shopping Center in the Town of Somers into the Peekskill Sanitary Sewer District. (04/13/04 –Also referred to B&A) [This item is from 2001 Public Works Agenda] {SIGNED OUT OF B&A on 04/19/04}

Leg. Oros stated he would prefer to keep this referral on a “permit because it limits the flow” and also questioned where the $1,000,000 is going to.

Comm. Butler (DPW) stated that “if a plan is diverted, the funds that DEP would have spent to upgrade that plant, which is $1,000,000 +, would be transferred or credited to the East of Hudson fund to be used on other sanitary projects.

Leg. Oros stated that once this parcel is put in, “we lose control of capping the flow,” and have no idea what may come down the road at that shopping center in terms of expansion.

J. Phelan (DEF) stated the flow is permanently controlled by the construction connection and can only be changed with a permit granted by the County

Leg. Pinto stated that the County should have more involvement in the spending of East of Hudson money.

Motion by Leg. Rogowsky. Second by Leg. Pinto. All those is favor – Aye – (Leg. Oros left the room) Carried 2-0.

3. HONS. MICHAEL KAPLOWITZ & GEORGE OROS: Sewer District Modification: Request from the Town of Yorktown that one parcel of land (1356 Artis Rd.) is incorporated into the Peekskill Sanitary Sewer District. (03/08/04 – Also referred to B&A)

Motion by Leg. Rogowsky to forward to Administration for processing. Second by Leg. Pinto. All those in favor – Aye – Carried 2-0.

7. HON. MICHAEL KAPLOWITZ: Sewer District Modification: Resolution from the Town of Yorktown requesting that the County incorporate two parcels (2399 Hunterbrook Rd. and 2401 Hunterbrook Rd.) from the Hunterbrook Sewer District into the Peekskill Sanitary Sewer District. (02/09/04 - Also referred to B&A)

Motion by Leg. Rogowsky to forward to Administration for processing. Second by Leg. Pinto. All those in favor – Aye – Carried 2-0.

Second vote taken to make it official after Leg. Oros left the room:

Motion by Leg. Rogowsky to forward to Administration for processing. Second by Leg. Ryan. All those in favor – Aye – Carried 3-0.

Leg. Pinto stated the Chairman of the BOL, Bill Ryan has now joined the Committee meeting after Leg. Oros walked out of the meeting on the vote for referral # 1(above), believing that if he left the room there would not be a quorum of 3 present to sign out the referral. A legal opinion of the County Attorney determined that 3 members of the Committee must be present to start a meeting and 3 members of the Committee must be present to make an official vote. The Committee on Public Works requires that the majority present can sign out and approve an item so for the purposes of making a decision, Chairman Ryan has joined the meeting. There is now a quorum of 3 present with Chairman Ryan. A re-vote was called on referral # 1 (above).

Chairman Ryan stated that it is unfortunate that he has to be brought in under these circumstances due to the Minority Leader’s actions of leaving the meeting.
