With a quorum present, the Committee on Legislation was called to order at 1:23 p.m.

LEASE AGREEMENT WITH PIEDMONT HAWTHORNE AVIATION
With a quorum present, the Committee on Transportation was called to order at 1:33 p.m.

(Bronz,Oros) move for all purposes for The Committee Legislation (Abinanti, Rogowsky) move for all purposes for The Committee on Transportation the lease agreement with Piedmont Hawthorne Aviation for space at the Westchester County Airport.

Chairman Rogowsky explained that this item was recommitted after the last Board meeting because the date in the local law needed to be amended to be consistent with the Committee Report. The effective date has been properly corrected to read January 1, 2006 for a term of ten years with Piedmont having the option to renew the lease for two additional ten year terms.

Motion passed the Committee on Legislation 7-0 (Abinanti without prejudice). Motion Passed Committee on Transportation 2-0. (Abinanti without prejudice)

(Abinanti, Rogowsky) move to adjourn Committee on Transportation. Motion passed 2-0. Transportation Committee adjourned at 1:36 pm.

REGULATION OF TANNING FACILITIES
With a quorum present, the Committee on Health was called to order at 1:33 p.m.

The Committee’s decided to change the prohibition to under 16. Chairman Rogowksy requested the County Attorney provide two options. One which just prohibits children under the age of 16 and the other which will include a requirement for in person parental permission for 16 and 17 year old children. They also discussed what language needs to be in the notice of permission.

The legislators requested a chart of how violations are enforced for the various regulations which were approved over the past few years, such as for Ephedra and the Indoor Clean Air Act. The committee requested the County Attorney take a look at the New York State Public Health law to see what the county is permitted to legally regulate and enforce. The County Attorney’s office needs to see if we can license and charge fee’s like Rockland County is currently doing. Chairman Rogowsky requested that legislators be provided with a copy of the relevant section of the New York State Public Health Law. We also need to make our State Legislators aware the State Department of Health is falling short on enforcing the law. It maybe more effective to allow the counties to do the job.
