COMMITTEE ON LEGISLATION



MINUTES: November 28, 2005

With a quorum present, the Committee on Legislation was called to order at 1:10 p.m.

Chairman Rogowsky talked about his proposal for the consolidation of all operations and maintenance costs incurred in the County Sanitary Sewer System.

Dan Palloni from Bennett Kielson discussed how the financial numbers were calculated to show the tax impact in each sewer district.

Discussion followed amongst the committee about how consolidation will work and how it will affect homeowners in different municipalities.

Sue Gerry of the County Law department stated if the legislation were to break up the consolidation effort there could be a legal problem pertaining to equity.

Chair Rogowsky stated this was a preliminary discussion. There will be a future meeting held jointly with the Committee on Budget and Appropriations and the Committee on Public Works.

At the request of Legislator Burrows there was a discussion about the Ridge Hill project in Yonkers. Sue Gerry discussed the issue of the legal requirement for the City of Yonkers to need a super majority vote for approval of a project which the county planning board has rejected.

Chair Rogowsky at the request of Legislator Abinanti asked the County Attorney’s office to draft a resolution to proceed with litigation against the Yonkers City Council.

(Abinanti, Pinto) Move to adjourn The Committee on Legislation. Motion passed 5-0.
