COMMITTEE ON LEGISLATION

MINUTES: FEBRUARY 9, 2004

The meeting was called to order at 1:10 p.m.

Valuation Date for Real Property (Related to Items #8a & b)

Brendan McGrath, Assistant County Attorney, briefed the Committee on the proposed local law amending the County’s Administrative Code. The amendment would create an option for local towns to elect to use an alternate date for the valuation of real property in Westchester County by local option. Mr. McGrath also stated that it would have no fiscal impact on the County.

This is the result of Committee discussion held on January 26, 2004 in which the Towns of Rye and Pelham petitioned the Board to create this option.

There was a brief discussion.

Legislator Oros made a motion to sign out the Local Law for all purposes and it was seconded by Legislator Pinto. The vote was 6-0.

2004 Joint State Legislative Package

The members began to analyze items submitted for inclusion into the package and divided them into several categories. The consensus of the Committee thus far is as follows:

§ Require The State Education Department To Pay For All Excess Committee On Special Education Administrative Costs

§ Reform Medicaid = attach Board of Legislators’ resolution and a list of reforms.

§ Require 3rd Party Insurance Reimbursement For Early Intervention Services

§ Require State Parole Violators To Be Immediately Placed In State Custody

§ Increase Reimbursement for Housing and Medical Care Of State-Ready Inmates And Parole Violators = Awaiting Addt’l Info on 3rd Party Insur. Reimbursement and County Budget Allocation.

§ Initiatives

§ Create The Offense Of Unlawful Distribution Of Bomb-Making Information

§ Require Fingerprinting Of All Probationers

§Out

§ Allow Local Gov’ts To Take Advantage Of The Purchasing Power Of The Federal Gov’t

§ Expand The Bottle Bill

§ Stop Unfunded Mandates = calls for change in constitutional language.

§ Provide an Insurance Discount for Emergency Alert Radios = too premature.

§ Prohibit Drowsy Driving

§ Increase Penalties For Impersonating A Police Officer And For Unauthorized Use Of A Police Uniform

§ Establish A Sex Offender Management Board

§ Set Aside For Further Discussion

§ 6 Recommendations From The “Protect The Kids Committee”

§ Need Additional Information And Further Discussion

§ Give Peace Officer Status To Security Personnel At Nuclear Power Plants = Departments Of Public Safety & Law to come and discuss.

§ Permit Westchester To Set Its Own Pistol Permit Fee = Departments Of Public Safety & County Clerk to come and discuss.

Joe Montalto, Director of Playland, briefed the Committee on a proposed act to amend NYS General Municipal Law in relation to purchase and sale agreements for municipally owned amusement parks. Generally speaking, Mr. Montalto wants the authority to enter into agreements concerning rides and attractions without being required to go through public bidding. Also, it is requested that he have the authority to bypass the requirements of a procurement policy. Request and authorization of monies would still have to be approved by the BOL.
