COMMITTEE ON LEGISLATION

MINUTES: April 18, 2005

The Legislation Committee was called to order at 1:37 p.m.

Chair Rogowsky introduces the issue of leaf hauler licensing proposed by the County Executive’s office.

The Chair recognized Commissioner Anthony Landi of the Department of Environmental Facilities and Bruce Berger of the Solid Waste Commission. Bruce and Commissioner Landi explained the context of the leaf hauler amendment as a temporary 2 year license agreement with private contractors to haul leaves in Westchester County.

Chair Rogwsky expressed concern as to whether complete background checks would be initiated on behalf of the private leaf haulers under the class L license. Mr. Berger replied that there would be a complete in house background investigation done.

Following discussions it was decided to amend the original legislation regarding leaf haulers to amend 826.303 adding class L to the title in place of section 3. Change to section 6 to amend 26.303 to insert the words class L.

Chair Rogwsky asked the administration to draft these changes. The Chairman asked that legislation meet next time with the Solid Waste Commission subcommittee jointly in order to review the new version of the legislation.

The chair recognized John Liszewski from the City of Yonkers . Mr. Liszewski expressed the urgency to have this legislation passed in a timely fashion so that municipalities could begin to prepare for the fall leaf season. leaves hauled in a timely fashion

Chair Rogowsky introduced the other proposed amendments to the solid waste law. These are technical amendments offering a sliding scale on the transfer station fee to encourage more recycling in the county.

It was decided that Legislation and Solid waste would meet the following Monday in order to vote on this legislation.
