COMMITTEE ON PUBLIC SAFETY & CRIMINAL JUSTICE JOINT W/ HEALTH

MINUTES: JANUARY 18, 2005

The meeting was called to order at 9:20 by Chairman Richard Wishnie

The first item was a discussion of receiving & filing the following items: 1, 5, 6, 7, 8, 11, 13, 21, 22, 29, 30, 31, 33, 38, 39, 40,42, 43, 44, 45, 47, 48, 49, 52, 53, 55, 56, 57, 59, 60, 62, 63. Item 60 is still in Legislation and it was left on. Item 47 (Smart Gun Technology) should be kept on and Commissioner Belfiore should be asked to come in and discuss it. On the motion of Legislator Kaplowitz, seconded by Legislator Rogowsky, the other items were received and filed. Legislator Kaplowitz asked the status of #73 – Technical Rescue. Chairman Wishnie explained that Commissioner Sutton is reaching out to the Union and a meeting will be scheduled as it is too important to drag on. Legislator Pinto asked that all the legislators be notified when a meeting is scheduled.

The draft copy of the Bonner case was then discussed. Chair Wishnie commended all the members for the excellent job that was done in examining the evidence. The draft has all the issues based on testimony. The Committee doesn’t know how Mrs. Bonner felt and they don’t know everything that happened. They can only go on what was provided to them. They do know that Mr. Bonner had guns in his possession, failed to meet with his parole officer, and had numerous violations of the law.

It was suggested that a sub-committee be formed consisting of the Commissioner of Probation/Corrections and experts on domestic violence so that this discussion can continue as domestic violence takes place day in and day out.

Legislator Kaplowitz felt the report was very good. Thinks the sub-committee is a very good idea.

Legislator Rogowsky was concerned about the Violation of Probation petition that requested a warrant for Mr. Bonner. This was sent to the court on September 1, 2004, it was signed by Judge Dickerson on September 9 and received by the County Department of Public Safety on September 13. Legislator Rogowsky is concerned about the time lag. Doesn’t technology make it faster. There also was a discussion in Committee as to which office should have prosecuted the violation the District Attorney or the County Attorney.

Chairman Wishnie suggested that Legislator Rogowsky draft a few sentences concerning this issue.

Legislator Spreckman was not at the meeting and Chairman Wishnie would like to receive her comments. The next meeting will be on Monday February 7 at 9 a.m. to continue the discussion.

On the motion of Legislator Kaplowitz, seconded by Legislator Rogowsky, the meeting was adjourned at 9:40 a.m.
