With a quorum present, the Committee on Budget and Appropriations was called to order at 9:35 a.m.
Please note: Due to technical difficulties the Capital Project Budget presentations were postponed until the next Committee meeting.
ITEM A25/C71(BLA01)
A25 is an Act authorizing the County to enter into a lease agreement with NYS for property adjacent to Tibbetts Brook Park in Yonkers. The lease term will not exceed 10 years at a $1.00 per year rate. The County will construct a ball field for use by all County residents on the 3 acres parcel.
C71(BLA01) is the attached $7,300,000 Bond Act which will finance the construction costs associated with project.
This item was previously discussed at length and held over until concerns regarding the City of Yonkers commitment to the project were satisfied. The CE”s office informed the members the City had forwarded a Resolution of its commitment.
A discrepancy regarding the time difference in the length of the 10 year lease agreement and the 15 year Bond Act, was noted.
On the motion of Legislator Stewart-Cousins, seconded by Legislator Ryan the item carried 6-0. Legislators LaMotte, Oros without prejudice.

An Act authorizing the County to enter into an IMA with the Town of Cortlandt whereby the Town will operate and maintain 2.5 acres of County parkland for municipal recreation purposes. The area is adjacent to Maple Avenue.
On the motion of Legislator Oros, seconded by Legislator LaMotte, the item carried 6-0.

A request to initiate an action, to evict Leading Edge Interiors, Inc. from County owned premises located at 2 Loop Road, Westchester County Airport, New York. Leading Edge breached the terms of the lease when it failed to pay the allocated real estate taxes for the property for the period from 1998 through 6/7/2004, resulting in $37,833.73 in arrears. $3,277.47 in arrears have resulted due to their neglect to pay allocated utilities for the property for the same period.
All work for this action will be done in-house by the County Attorney’s office. The County is on a list of creditors; there is no indication as to the percentage of the amount expected to be recovered.
On the motion of Legislator Bronz, seconded by Legislator Oros the item carried 6-0.
With no further business to discuss, the meeting adjourned at 10:32 am.
