With a quorum present, the Committee on Budget and Appropriations was called to order at 11:14 a.m.
ITEM A20/C131
Act amending the 2005 County Operating Budget and issuing $4,500,000 in bonds for payments for various judgments and claims against the Medical Center. All of these claims are pre-1998 6-n liabilities.
A schedule of Capital Projects (and the related bond amounts issued by the County on behalf of the Medical Center) that were not in fact completed was requested.
On the motion of Legislator Rogowsky, seconded by Legislator Alvarado the item carried 5-0.
MINUTES
On the motion of Legislator Bronz, seconded by Legislator Myers the minutes of March 7, 2005 were approved as amended 5-0.
RECEIVE & FILE
On the motion of Legislator LaMotte, seconded by Legislator Myers a Correspondence regarding V.E. Macy Ball Field improvements was received and filed 5-0.
CDBG Resolution
This Resolution drafted by Department of Planning Deputy Commissioner Norma Drummond supports the Community Development Program and urges Congress to restore its funding.
On the motion of Legislator LaMotte, seconded by Legislator Bronz the item carried 5-0.

On the motion of Legislator Rogowsky, seconded by Legislator LaMotte a package of court ordered refunds was received and filed 5-0.
ITEM A22
Act authorizing the settlement of the lawsuit Khan v. Westchester County & Liberty Lines Transit in the amount of $275,000. The County will pay $250,000 out of the self-insured retention fund and the excess carrier, Genesis Insurance Company, will pay $25,000. On September 15, 2004 a jury reached a verdict attributing to the County 70% fault for the plaintiff’s injuries.
It was suggested a comprehensive survey of potential blind spots for drivers or design flaws to the articulated buses. If such a report has already been done an update of the findings was requested.
On the motion of Legislator Bronz, seconded by Legislator Oros the item carried 5-0.

$350,000 Bond Act to fund the design and construction improvements cost to the vehicular bridge on the Bronx River Parkway immediately north of the Green Acres Avenue exit in Scarsdale. Bridge rating 4.75
On the motion of Legislator LaMotte, seconded by Legislator Bronz the item carried 5-0.

$350,000 Bond Act to fund the design and construction improvements cost to the vehicular bridge on the Bronx River Parkway immediately south of the Claremont Avenue exit in Scarsdale. Bridge Rating 4.89
On the motion of Legislator LaMotte, seconded by Legislator Oros the item carried 5-0.

$355,000 Bond Act to fund the design costs in connection with the resurfacing of approximately 5.0 miles of roadway Pines Bridge Road and Ryder Road– Route from 9A to Kitchawan Road (Road 134). Total project cost estimated at
On the motion of Legislator Oros, seconded by Legislator Kaplowitz the item carried 5-0.
ITEM C129 (B004A)
$200,000 Bond Act to fund the design, construction management and construction in connection with the replacement of the underground steam and condensate piping between the Central heating plant and the garage at the Valhalla campus.
On the motion of Legislator LaMotte, seconded by Legislator Myers the item carried 5-0.
