With a quorum present, the Committee on Budget and Appropriations was called to order at 9:51 a.m.

(Wishnie; Rogowsky) moved to accept the minutes of February 4, 2004; February 9, 2004; February 9, 2004 joint with Youth and Public Safety; February 23, 2004; and March 1, 2004.

(Wishnie; Rogoswsky), moved to Receive & File Items A6 & A19: Pay Plan Amendments for the Board of Legislators.

(Wishnie; Rogowsky) moved to Receive & File agenda items B1, B26, B31, B32, & B66 Sewer District Modifications in Town of Yorktown.

ITEM A1

(Wishnie; Rogowsky) moved to accept a gift of a refrigerator from Adele Dowling valued at $600 for Parks & Recreation use

(Wishnie; Bronz) moved the package of court ordered refunds to be paid by the Commissioner of Finance.

ITEM A5

(Wishnie; Rogowsky) moved the authorization of payment of mortgage tax receipts by the Commissioner of Finance.

Chairman Kaplowitz requested the Board get a monthly report from Clerk’s office and Finance office of the mortgage tax receipts. He also suggested a memo be sent to the County Attorney asking her for a legal opinion on whether the Board of Legislators needs to approve the money from the mortgage tax receipts before it is disbursed.

With a quorum present, the Committee on Public Works was called to order at 10:00 a.m.

(Wishnie; Pinto) moved for Public Works; (Wishnie; Kaplowitz) moved for Budget and Appropriations $270,000 bond act and budget amendment for the Port Chester Wastewater Treatment Plant; $270,000 bond act and budget amendment for the Blind Brook Wastewater Treatment Plant; $1,765,000 bond act and amendment for the Mamaroneck Valley Wastewater Treatment Plant items $3,830,000 bond act and budget amendment for the New Rochelle Wastewater Treatment Plant

Legislator Wishnie requested Chairman Kaplowitz write a letter on behalf of the committee to the New York State Department of Environmental Conservation suggesting Nitrogen removal from the Long Island Sound be achieved in the most cost effective manner and in partnership with all the states and municipalities involved. There could be a way to accomplish the project which would be less expensive to Westchester taxpayers.

With a quorum present, the Committee on Environment was called to order at 11:08 a.m.

ITEM A9
(Wishnie, Kaplowitz) moved for the Budget and Appropriations Committee; (LaMotte, Maisano) moved for the Environment Committee to release $7,500,000 in East of Hudson Investment funds to the twelve “Westchester Watershed Municipalities” and amended the legislation to place the $7,500,000 in to a trust fund and direct the first 3.7 million to be released to the municipalities and the second 3.7 million will come back to the Board of Legislators for approval of each project.

Motion for Budget & Appropriations passed 8-0.

Motion for Environment passed 5-0.

ITEM A24
IMA with Village of Mamaroneck to restore Wetlands located in the vicinity of the Mamaroneck harbor outfall jetty to their natural site. The County would contribute $500,000.

The IMA Will be discussed at a future Committee meeting.

(Kaplowitz, LaMotte) Moved to adjourn Committee on Environment.

Motion Passed 5-0.

The Committee on Environment adjourned at 11:58 am.

Item #6. Legislator Oros asked why an archeological study is needed.

Item #3. Legislator Stewart-Cousins requested a copy of the resolution and a copy of the budget.

(Wishnie,LaMotte) Moved to adjourn Budget.

Motion approved 8-0.
