With a quorum present, the Committee on Budget and Appropriations was called to order at 9:47 a.m.

MINUTES
On the motion of Legislator Rogowsky, seconded by Legislator Wishnie the minutes of June 7, 2004 and June 14, 2004 were carried 7-0. Abinanti out for vote.

CSEA Contract and Budget Amendment

Mr. Wittenberg gave a detailed account of the CSEA contract negotiations he recently conducted on behalf of the County. He explained the new salary rates, retiree benefits and changes to the employee health plan, adding the new contract will affect significant cost savings over the next 4 years.

An Act to amend the 2004 County Operating Budget increasing departmental appropriations to fund the retroactive portions of the settlement for the period of 1/1/02-12/31/03.

On the motion of Legislator Wishnie, seconded by Legislator Bronz the CSEA Contract carried 8-0. Abinanti out for vote.

On the motion of Legislator Wishnie, seconded by Legislator Stewart-Cousins the Budget Amendment carried 8-0. Abinanti out for vote.

WCC Budget Resolution

Three Resolutions setting the rules of conduct and date for a Public Hearing on the proposed 2004/2005 Westchester Community College Budget.

On the motion of Legislator Mosiello, seconded by Legislator Wishnie the item carried 7-0. Legislator Rogowsky, Abinanti out for vote.

With a quorum present, the Committee on Housing was called to order at 10:48 am.


ITEM A15
An Act authorizing the amendment of a previous agreement whereby the County purchased and conveyed certain property in White Plains to White Plains Avenue, LLC for the purpose of constructing affordable housing and to consent to the assignment of the existing agreement as amended, by White Plains, LLC to Kensico Terrace, LLC.

For Budget: On the motion of Legislator Wishnie, seconded by Legislator Stewart-Cousins the item was carried 6-1. Legislator Mosiello voted in the negative, Rogowsky, Abinanti out for vote.

For Housing: on the motion of Legislator Ryan, seconded by Legislator Pinto the item was carried 3-0.

The Committee on Housing was adjourned at 11:00 am.

ITEM 8
An Act commencing legal action against Westchester Rubbish, Inc. and all parties deemed appropriate for the recovery of solid waste disposal fees due in connection with its use of County’s solid waste disposal system.

On the motion of Legislator Wishnie, seconded by Legislator LaMotte the item carried 5-0. Legislators Ryan, Stewart-Cousins, Abinanti and Rogowsky out for vote.

ITEM A17
An Act to retain the law firm of DelBello, Donnellan, Weingarten, Tartaglia, Wise & Wiederkehr, LLP in connection with the County’s opposition to the Millenium Pipeline, including any associated lawsuits, proceedings, hearings, filings, etc. DelBello, Donnellan will be employed in an “of counsel” capacity to the County attorney.

On the motion of Legislator Wishnie, seconded by Legislator Rogowsky the item carried 5-0. Legislator LaMotte voted in the negative, Legislators Ryan, Stewart-Cousins & Abinanti out for vote.

ITEM A11
An Act authorizing an agreement with the WCHCC for primary and oral health care services for individuals residing in the Counties of Westchester, Rockland and Putnam who have HIV/AIDS for the budget period from 3/1/04 through 2/28/05.

On the motion of Legislator Wishnie, seconded by Legislator Bronz the item carried 6-0. Legislators Ryan, Stewart-Cousins and Abinanti out for vote.

ITEM A12
An Act authorizing an agreement with the WCHCC for colorectal cancer screening services for residents of the County for the period commencing 4/1/04 through 3/31/05. Payment will be made by the County in an amount not to exceed $50,000.

On the motion of Legislator Mosiello, seconded by Legislator Wishnie the item carried 6-0. Legislators Ryan, Stewart-Cousins and Abinanti out for vote.

ITEM A16
A Local Law authorizing the County to enter into various agreements with the Dormitory Authority of the State of New York (“DASNY”) and the NYS Unified Court System which outlines their perspective responsibilities with regard to the completion of the Westchester County Courthouse reconstruction Project and the financing thereof.

After some discussion, request was made that all revisions reflected in this legislation be identified in some way obvious way and the item was held.

ITEM C32
A $500,000 dollar Bond Act to fund design in connection with the reconstruction of 3.64 miles of roadway including resurfacing, drainage repairs, reflectorized pavement markings, shoulder repairs and related work on Hardscrabble Road in the Town of North Salem.

(A recommitted item previously approved by the committee).

On the motion of Legislator Wishnie, seconded by Legislator Bronz the item carried 5-0. Legislators Ryan, Stewart-Cousins, Mosiello and Abinanti out for vote.

ITEM C34
A $200,000 dollar Bond Act to fund the cost of design, construction management and construction in connection with the resurfacing of 0.24 miles of roadway in the Town of Bedford. (A recommitted item previously approved by the committee).

On the motion of Legislator Wishnie, seconded by Legislator Bronz the item was carried 5-0. Legislators Ryan, Stewart-Cousins, Mosiello and Abinanti out for vote.

ITEM C58
A $480,000 dollar Bond Act to fund thecost of designing the replacement of the existing locking systems in the 1932 Jail and women’s Unit in the Correctional complex at the Valhalla campus at Grasslands. (A recommitted item previously approved by the committee).

On the motion of Legislator Wishnie, seconded by Legislator Bronz the item was carried 5-0. Legislator LaMotte, without prejudice; Legislators Ryan, Stewart-Cousins, Mosiello and Abinanti out for vote.

ITEM C69
A Capital Budget Amendment and $1,000,000 dollar Bond Act for the Bronx River Parkway repaving Program. The amount will fund the design, construction management and construction costs and all related work on the 8.55 miles along the Parkway.

On the motion of Legislator Wishnie, seconded by Legislator Mosiello the item carried as amended, 6-0. Legislators Ryan, Stewart-Cousins were out for vote.

STARTER “A”
An IMA with the Village of Tuckahoe for the installation of a curb, sidewalk and parking lane project along Midland Avenue to the Bronxville border, approximately .21 miles.

On the motion of Legislator Wishnie, seconded by Legislator Mosiello the item carried 6-0. Legislators Ryan, Stewart-Cousins were out for vote.

STARTER “B”
An IMA with the Town of Eastchester, the Eastchester fire Department and the Eastchester Volunteer Ambulance Corps. for the County to provide and install an emergency pre-empt traffic signal in front of the Fire House and additional components required for operation of the traffic signal. Maintenance of the traffic signal will become the sole responsibility of the Town upon completion of the installation.

On the motion of Legislator Wishnie, seconded by Legislator Mosiello the item carried 6-0. Legislators Ryan, Stewart-Cousins were out for vote.

With no further business to discuss, the meeting adjourned at 12:05 pm.
